Well, the people of CA have decided otherwise. Their state determines if and when Manson fries. In TX, he'd have been toast. The rest of us, under free association, are totally free not to live in CA or TX under either model of justice. Or, we are free to move there, to seek that model of justice.
Issues like capital punishment and right to life, etc. are complex, and should be left to the states to run 50 experiments in parallel.
But then, so is MW. I don't see why a national MW law is either necessary or desirable. In fact, the fewer national laws directed inward, the better, especially when it comes to our economies, plural.
We just experienced the catastrophe of letting 'the economy runners' treat them all as if they were an 'it.'
