From the article

"The very idea that a judge's "life experiences" should influence judicial decisions is as absurd as it is dangerous.

"It is dangerous because citizens are supposed to obey the law, which means they must know what the law is in advance-- and nobody can know in advance what the "life experiences" of whatever judge they might appear before will happen to be."

I think this article exposes the line of attack that might derail Sotomayors' nomination if she continues to stand by her racist and arrogant "wise Latina" comment:

http://www.realclearpolitics.com/articles/2009/05/31/sotomayors_aversion_to_impartiality_96737.html

And, if anyone thinks that comment isn't racist, imagine the revulsion if a white male nominee to SCOTUS had said this:

"I would hope that a wise Latina woman white male with the richness of her his experiences would more often than not reach a better conclusion than a white male Latino or a woman who hasn't lived that life."
