| | This was interesting, given how rare it is that Ralph Nader would say something many of us would be interested in. He went on to say that we need a constitional amendment that would allow the people to go to the courts and challenge unconstitutional behavior - illegal behavior. "Right now," he said, "the courts say to all Americans, 'you have no standing to sue... This foreign policy stuff is a political issue and we are not going to deal with it' and that leaves a huge hole in our system."
The founders, looking at one another perhaps, were too trusting of the elected representatives. They didn't put in a way to recall Senators or Congressmen or to bring any number of issues before the supreme court (no matter what lower court they start in.)

[answering the question, 'What are we to do when the president behaves in a blatantly unconstitutional fashion?'] The only remedy in the constitution is the impeachment remedy. Unfortunately, the framers never dreamed... that when they separated the powers between legislative, executive and judicial that one branch would give up its constitutional authority, the way Congress has. We now have, increasingly, an elected dictatorship - no matter which party is in the White House.
